A Look at Proposed Gun Legislation

Our proposed bill creates a law that would allow a person in their own home or car to use deadly force against someone who unlawfully enters their home or car. In other words, if you wake up in the middle of the night and find an uninvited person in your kitchen, the guesswork under Idaho’s current law about whether the person intends to harm you is eliminated. 

Instead, you would be allowed to use deadly force to defend yourself against the intruder. This is because the new laws says that if un uninvited person (with a few exceptions, such as a law enforcement officer acting in the course of his or her official duty) is in your home, you can presume that person intends to cause you great bodily harm or kill you. You would therefore be justified in taking action, including using deadly force, to protect yourself and your family.
